大家好。这是J.TUNE ENTERTAINMENT最近在一些影迷网站发生利用艺人肖像、推销商品的事件，在很多国家（包括韩国在内）经常发生不经过权利所有者的许可、任意使用艺人肖像的问题。为提醒大家，我们在此发布有关知识产权的通知。 内容如下 ： -近来权利所有者或公司向违法复制、传播的网站、管理者以及个人直接要求法律责任的趋势越来越频繁。 -一般情况下，广告照的使用权归广告公司所有，演唱会照的使用权归是演唱会版权所有公司所有。 不管是什么情况，只要不经过权利所有者同意擅自使用作品，就不能免除法律责任。-尤其是海外的违法使用者容易引起法律纠纷，这样会直接牵连到网站管理者（个人，法人）或制作者法律责任。-如果影迷们针对某作品有需求，可以直接向本公司咨询，我们会尽全力解决的。-为了确保知识产权，应经过正式渠道获得使用许可权。 故此，请影迷们的积极合作。为了防止影迷们受到法律上的不利，我公司也将全力以赴。 谢谢你们的合作。

Hereby we would like to talk about the copyright issue with regards to the goods manufactured by fan clubs. These days it often happens that fans use artists’ portrait without getting permission from the right holders both domestically and internationally; the legal responsibility regarding Intellectual property, portrait, copyright, neighboring right is getting reinforced. Therefore, please be aware of that you will be responsible for those unproved contents regardless of the aim and should take a proper step to get the approval from the right holders in order to use those contents. If you ask us, we will do our very best to help you. Basically, all the contents related to the artists who belong to J.Tune Entertainment Co., Ltd belong to the company; the advertisers own the right for the pictures related to the endorsement, and the right holders of the concerts own the right for those pictures related to those concerts. The right owners of contents are entitled to ask the legal responsibility to any person(s) or any company(s) which owns or runs a website which copies and/or reproduces the contents illegally and share them with people. In the event that some fans make the diary and the calendar without getting approval from those copyright holders, they will take the responsibility for it. We will try to arbitrate this issue as best as we can, but please keep in mind that we cannot support those illegal activities. Check out your fans’ cafés or fans’ websites if they have any illegal contents without presenting the source, and please delete them right away and give people a notice regard it. 官网的中英文版本都出来了虽然有点慢报但是J-Tune以后应该都会有三种语言版本的公告

大家好. 这是J Tune Entertainment. 关於现在造成问题的fanclub自制物品 在此针对著作权来做个说明. 不仅是韩国连其他国家艺人的肖像权也是 在没有和权利人协商就使用的情形非常多. 现在智慧财产权, 肖像权, 著作权, 引用权等 许多法律上的责任已经加强了. 本公司所属艺人的作品是由J Tune Entertainment管理 关於这点 (肖像权) 的详细说明如下. 请熟记这点并希望大家小心不要受害. - 作品所有人或是所有公司对於擅自违法复制散布的网站及管理人或是个人 会追诉其法律上的责任. 广告照片的肖像权是广告公司 演唱会照片的肖像权是演唱会版权所有公司所拥有的. 和这次fan制作的记事本和月历一样 擅自使用广告照片之类的情况 上记事项也一样适用. 本公司会尽全力居中协调但帮助也是有限度的. - 如果, 现在我所属的fancafe或fanpage里面有没出处违法使用的作品 请做确认并立刻删除后公告. - 不管是什麼目的只要是使用没有得到许可的作品就必须负起法律上的责任, 必须到该资料的著作权所有处所循正当程序取得使用许可才行. 或是, 歌迷朋友们跟本公司询问的话将会尽全力为大家协调. 特O是, 海外的情况将针对 on / off line 所有未取得许可擅自使用的作品 会强力的以法律来处理, 对此不响应的网站管理者(个人,法人)或是制作者 必须直接负起法律上的责任. . 请熟记这点并且一定要做确认以免发生法律上的问题. 本公司希望歌迷朋友们不会因这样的问题而受害. 会在最快的时间内准备连络窗口因应类似本案例的谘询 将会准备能够对fan活动尽力协调的方案. 谢谢.
