(hereafter referred to as “client”) agree to retain the legal services of John J. Kenkel of the law firm of deKieffer & Horgan (referred to as “contractor”) to represent it in the administrative review of the U.S. antidumping duty order on fresh garlic from the People’s Republic of China before the U.S. Department of Commerce (“DOC”). Mr. Kenkel will provide complete legal, accounting and computer services during this single review, which covers the period November 1, 2005 through October 31, 2006. The services provided by Mr. Kenkel include full legal representation before the U.S. Department of Commerce. This includes filing of required submissions, legal research, legal advice to the client, personal visits to exporter to assist it in preparation of submissions and for verification, analysis of DOC’s preliminary and final results, preparation of all required legal briefs, appearance at the public hearing, if one is held, to testify on behalf of the client, and the filing of any other documents to defend the client’s interests in this matter. Thus, between the date of signature on this contract and the date of the final results in the antidumping administrative review noted above, all professional legal services are included. The contract does not include any representation after DOC issues its final results in this specific review. This contract does not include (1) representation before any court of law in the U.S., (2) representation in any subsequent administrative review, or (3) any monitoring program geared toward participation in a future administrative review. The fee includes all expenses incurred in the U.S., e.g., photocopying, overseas airline ticket, telephone, couriers, etc. This fee does not include those expenses incurred within China, e.g., air travel, hotel, food, etc. Expenses within China are either to be paid directly by the client or reimbursed by the client.
